The Treaty Establishing a Constitution for Europe and challenges for criminal law at the commencement of 21st century
This article discusses the treaty that establishes a constitution for Europe and its challenges for criminal law at the beginning of the 21st century. Criminal law has established its importance for the European Union when the European Economic Communities was stabilized. The European Union's desire for the effectiveness of the common market and free movement of goods and persons the aim of protecting its economic interests led it to use criminal law. In line with this are the provisions of the Constitutional Treaty concerning criminal law. These provisions make the European Union the primary holder of competence in the area of judicial and police cooperation in criminal matters.
