The Commission's Proposal for a Directive on the fight against fraud to the Union's financial interests by means of criminal law
The Commission's proposal for a directive on the fight against fraud to the Union's financial interests (COM (2012) 363 final) is a significant instance in the course of the EU's legislative activity in the field of criminal law. Given the importance and the self-evident interest for the changes in the field of protection the Union's financial interests, which the proposal is expected to trigger, the following commentary discusses its content on the basis of the Manifesto on European Criminal Policy (ZIS 2009, pp. 707 et seq., www.crimpol.eu ), shedding light on its merits and demerits with regard to fundamental principles of European Criminal Law. The commentary further aims to offer some concrete proposals for the amelioration of the Commission's provisions.
