Some reflections on the concept of due process: What kind of “doing justice” is emerging in contemporary criminal proceedings?
This paper explores the way in which the concept of due process is used and understood in contemporary criminal justice systems. In particular, ideas of due process and fair trial standards are discussed in both the context of international criminal procedure, and in the European Union perspectives. It aims at searching for answer to question about what kind of ' doing justice' is emerging in the contemporary criminal proceedings. This question seems to be of particular significance in view of the clear tendency towards globalised criminal justice of the 21 st century.
