Th is article analyses the way in which the migration debate is (mis)used for achieving criminal policy objectives and the way in which criminal law is used to accomplish certain policy goals in the migration field. By discussing this mutual instrumentalization from (primarily) an EU policy perspective, the reader is given a deeper and contextualised insight in the fact that not every policy measure actually serves the goal it is presented to serve.
