EU criminal law cooperation before and after the Lisbon Treaty - aspects and comments especially in relation to the Norwegian position
The Lisbon Treaty has fundamentally changed the parameters of European criminal law. Provisions on criminal law are now part of general EU law in the TFEU (Treaty of the Functioning of the European Union). This article will start with an analysis of the general changes brought by the Lisbon Treaty and the fact that the former third pillar now is part of the general EU law and the TFEU (chapter 2). This article further has three main areas of focus. These are substantive criminal law (chapter 3), procedural criminal law (chapter 4) and institutional cooperation (chapter 5). Each of these chapters analyses the legal situation both before and after the Lisbon Treaty. These chap¬ters include a part on the position of Norway in relation to these areas of crimi¬nal law and offer an overview of the connections between the EU criminal law measures and Norway. Finally, some comments are made on future aspects of EU criminal law and the Norwegian position (chapter 6).
