Collective entities as subjects of criminal law. The case of Belgium and the Netherlands
This chapter will start with a general overview of the Belgian system. After briefly discussing the principal substitute solutions for corporate criminal liability, it will focus on the regime of corporate criminal liability that was created in 1999. It will analyse its scope of application, the peculiar issue of concurring liability, and the penalties. It will then turn to the Dutch system and it will pay special attention to the similarities and dissimilarities with the Belgian liability regime.
