The Legitimacy of EU Criminal Law

My research question is to what extent does the EU follow a normative agenda in the field of harmonisation of substantive criminal law. More in details my project investigates the role for the “enforcement” and the “normative” rationale within the EU approach to criminalisation. The former perspective implies using criminal law as an enforcement tool to regulate human conducts. According to the latter approach, importance is also attached to the interests and the values at stake. To this aim I looks at the EU definition of competence in the field of substantive criminal law, the EU policy discourse on when is the use of criminal law legitimate, and at a selected number of legislative instruments.

Short bio: Irene Wieczorek is a PhD student at the Vrije Universiteit Brussels and at the Université Libre de Bruxelles (joint doctorate). She writes a dissertation titled "The Legitimacy of EU Criminal Law" under the co-supervision of Professor Paul De Hert (VUB) and Anne Weyembergh (ULB). She has been a visiting researcher at the European University Institute, at the University of Trento where she was invited as a guest lecturer, and at the Max Planck Institute for Foreign and International criminal law. She was also an informal visiting student at the University of Cambridge. In July 2014 she was awarded the Diploma of the Academy of European Law (European University Institute) for excellent examination paper. From October 2011 to March 2012 she interned for six months at the legal service and at the Italian desk at the Eurojust, the Judicial Cooperation Unit of the European Union. She holds a MA in European Interdisciplinary Studies from the College of Europe (2011), an LL.M, major European Law, from Maastricht University (2010) and a LL.M from Trento University (2010). She holds a BA from Trento University (2007) and a BA from Paris 13 University (2007).
