Shifts in the application of confiscation measures and its effects on the legal position of the convicted person

Due to a change in legislation, the financial capacity of convicted persons mainly plays a role in the execution phase of confiscation measures. This can result in a less accurate determination of the amount of money to be paid back to the State and less opportunity to call for attention to inability to pay. Convicted persons can be imprisoned for not fulfilling their obligation to pay the amount established in the confiscation procedure. This development can be investigated by conducting empirical research in a unique database of case files, to which the PhD candidate has exclusive access.

Short bio: Wouter de Zanger LL.M. started as a PhD Candidate at Utrecht University in November 2012. His research focuses on asset recovery and the execution of confiscation measures ('ontnemingsmaatregelen'). This research is funded by the Netherlands Organisation for Scientific Research (NWO). Wouter is attached to Utrecht Centre for Accountability and Liability Law. He is supervised by professor François Kristen and dr. Michiel Luchtman. Prior to starting his PhD research on asset recovery, Wouter has spent six months conducting research into positive obligations imposed by the European Court of Human Rights and their influence on Dutch liability law and criminal law. Besides his PhD research into asset recovery, Wouter is also interested in general aspects of criminal law and the influence of human rights instruments (mainly the ECHR) on national criminal law and criminal procedural law.
