Although the EIO Directive is an opportunity for a comprehensive reform of the framework for obtaining evidence in the EU, it remains to be seen whether a solution can be found to reconcile the different positions while at all costs avoiding creating a system that would make the work of judicial officers more complicated than in mutual legal assistance.
This uncertainty means it is too early to present the EIO in detail: it is impossible to know at this stage how it will look once negotiations have ended. This conference will however address the main characteristics of the proposal, analysing it in the light of other instruments of mutual recognition.
