Council Framework Decision 2009/948/JHA of 30 November 2009 on prevention and settlement of conflicts of exercise of jurisdiction in criminal proceedings
This framework decision aims to improve judicial cooperation between European Union countries, so as to prevent unnecessary parallel criminal proceedings concerning the same facts and the same person. In such cases, the FD provides for the obligation for the concerned authorities to enter into consultation. It does not however lay down binding rules on the resolution of the possible conflict of jurisdiction.
Interesting in this field are also Eurojust's guidelines for deciding which jurisdiction should prosecute, which are available in Eurojust's 2003 annal report.
