The Court of First Instance annuls the Council Decision 2007/868/EC of 20 December 2007  implementing Article 2(3) of Regulation No 2580/2001 on specific restrictive measures directed against certain persons and entities with a view to combating terrorism and repealing Decision 2007/445.

These decisions were notably adopted by the Council after the Court of First Instance had annuled Council Decision 2005/930/EC, in so far as it concerned the applicant (judgment rendered in the case T-228/02 (OMPI I)). 

The Court finds in particular that, in the light of all the relevant information and having regard to the particular circumstances of the case, proper and sufficient reasons have not been adduced for the continued freezing of the applicant’s funds under Article 1 of Decision 2007/868, in conjunction with point 2.19 of the list annexed to that decision, under the heading ‘Groups and entities’.
